NEPA Case Law Update Webinar

Please join us in Seattle and Portland on June 1 at noon for this NAEP Webinar: NEPA Case Law Update. Note that you must attend the in-person showing to take advantage of this member benefit!

The June 1 webinar, presented by P.E. Hudson of the Department of the Navy, Office of General Counsel, and Dr. Michael D. Smith of ENERCON, will provide an overview of the paper authored by Lucinda Low Swartz. Ms. Hudson will discuss the key National Environmental Policy Act (NEPA) federal appellate court decisions issued in 2015. In 2015, the U.S. Courts of Appeal issued 14 decisions involving implementation of the NEPA by federal agencies. The 14 cases involved 11 different departments and agencies. Overall, the federal agencies prevailed in 11 of the 14 cases (79 percent). Opinions will be analyzed for their implications and relevance to NEPA practitioners, with an emphasis on key lessons to be learned for improving NEPA practice.
